(5)     Loss of the right to medical suspension pay

Under ERA 1996 s 65(4), the employee will lose his right to be paid during a medical suspension if:

  1.  

    (i)     he unreasonably refuses an offer of suitable alternative work (whether or not the alternative work falls within the scope of his contract); or

  2.  

    (ii)     he refuses to comply with reasonable arrangements made by the employer to ensure his services are available (see ERA 1996 s 65(4)).
