(4)     The specified medical grounds

As noted above, the circumstances in which the statutory right to medical suspension pay arises are quite narrow. The employee may claim only if the suspension is on one of the grounds specified in ERA 1996 s 64(2). That subsection provides that an employee is suspended from work on medical grounds:

''if he is suspended from work in consequence of:

(a)     a requirement imposed by or under a provision of an enactment or of an instrument made under an enactment, or

(b)     a recommendation in a provision of a code of practice issued or approved under
