(4)     Employees covered by collective agreements

The Secretary of State may exclude employees from the right to a guarantee payment if they are covered by a collective agreement or an agricultural wages order which itself provides a right to guaranteed remuneration during lay off. This is done by the Secretary of State making an exemption order under ERA 1996 s 35. Somewhat surprisingly, s 35 does not require that the agreement (or order) should provide equivalent benefits to those set out in ERA 1996.
