The employee has no right to claim a guarantee payment where the failure to provide work is in consequence of 'a strike, lock-out or other industrial action involving any employee of his employer or of an associated employer'; ERA 1996 s 29(3). Section 13(1) of the EP(C)A 1978 originally excluded a claim if the failure was in consequence of a trade dispute involving any employee of the employer (or of any companies within the same group).
