(3)     Relevance of the worker's age

To qualify for the national minimum wage the individual must have ceased to be of compulsory school age (see NMWA 1998 s 1(2)(c) and s 55(4), (5)). Under NMWR SI 2015/621 reg 3, 'compulsory school age' has the meaning given to it by s 8 of the Education Act 1996, with the result that this age differs depending upon where in the UK the student is studying.
