The right to pay during medical suspension is granted by ERA 1996 s 64(1) and, as a general rule, applies only to employees. The term 'employee' is defined for these purposes by ERA 1996 s 230(1) (discussed at AI [5] ff), with the result that many casual workers will be excluded from this form of pay protection.
