There is one major threat to this 'Sutherland settlement' of the stress issue. In Majrowski v Guy's and St Thomas's NHS Trust [2006] UKHL 34, [2006] IRLR 695 a claim was brought by an ex-employee (based on alleged harassment by a manager) where foreseeability by the employer would have been difficult to show and, in any event, the claim was brought outside the usual three-year limitation period.
