D.     The application form

Relevant issues here include:


    —     Requesting name, address and qualifications is legitimate, however, it may be best to avoid asking for previous name, maiden name or marital status in view of the risk that this might give rise to a suggestion of discrimination against married persons.


    —     It is necessary for an employer to ask whether an employee needs permission to work in the UK in view of the obligations under the Immigration, Asylum and Nationality Act 2006. This is considered at para [20.01] ff below.
