(c)     Notice by the employee

The employer's right to notice from his employee likewise depends upon how long the employee has been employed. Until the employee has completed one month's continuous employment the employer must rely upon the agreement, express or implied. Thereafter it is entitled to at least one week's notice (ERA 1996 s 86(2)).

It was said in Hambling v Marsden Builders Ltd (1966) 1 ITR 494, that the relevant period of continuous employment was to be calculated to the date of expiry of the notice, not to the date upon which notice was
