C.     Imposed terms

The law may impose certain rights and obligations on the parties, irrespective of any actual agreement. What are referred to below as 'characteristic terms' (at para [39]) could also be seen a form of common law imposed terms, ie imposed by the courts as soon as a relationship is determined to be one of employment. These areas are set out in greater detail in Part 6 'Characteristics of the relationship' (para [139] ff).
