(6)     Appeals

It is possible for employers to appeal against an information notice, assessment notice, enforcement notice, penalty notice, or penalty variation notice issued by the ICO (DPA 2018 s 162). Appeals must be made to the First-tier Tribunal (Information Rights), which is a part of the General Regulatory Chamber (GRC). The First-tier Tribunal will hear the appeal and make a decision on it (DPA 2018 s 163).
