(3)     Breach of the duty of competence/care

An employee is under an implied duty to discharge his or her responsibilities with competence and due care. Where the employee breaches this duty, he or she will be liable for the loss incurred by the employer, not just in relation to the employer's own personal property, but also in respect of any losses suffered by the employer as a consequence of vicarious liability pursuant to which the employer has to compensate third parties injured by those he employs.
