Little more needs to be said in this regard other than that a wrongful dismissal (being a repudiatory breach of contract by the employer) will result in: (a) a claim for damages (see paras [510][518]); and (b) the employer being unable to rely on any restrictive covenants (General Billposting Co Ltd v Atkinson [1909] AC 118, HL; Briggs v Oates [1990] IRLR 472, [1990] ICR 473; and Living Design (Home Improvements) Ltd v Davidson [1994] IRLR 69, Ct of Sess).
