(2)     Definitions

The DPA 2018 defines the following commonly used terms:


    —     'Personal data' means any information relating to an identified or identifiable living individual (DPA 2018 s 3(2)). This does not mean that the information must be private information; publicly available information can also be personal data. Paper records are only covered if they are filed in an organised way (eg alphabetically) or there is an intention to put them on a computer (or other digital device): see eg Durant v Financial Services Authority [2003] EWCA Civ 1746, [2004]
