(1)     The right to a statement

An employee may in certain circumstances request a written statement giving particulars of the reasons for his or her dismissal, and the employer is thereupon obliged to supply one (ERA 1996 s 92(1) and (2)). In circumstances where the dismissal occurs during pregnancy or whilst the individual is on maternity or adoption leave, no request is necessary (s 92(4) and (4A)).
