(d)     Rights in relation to employment

During an assignment an agency worker has a right to be informed by the hirer of any relevant vacant post with the hirer, to give that agency worker the same opportunity as a comparable worker to find permanent employment with the hirer: SI 2010/93 reg 13(1). 'Comparable worker' is defined in reg 13(2) and (3) and it is provided in reg 13(4) that a hirer may give this information 'by a general announcement in a suitable place at the hirer's establishment'.

It is important to note that this right goes no further than the giving and receipt of information, as was made clear in Coles v Ministry of Defence
