During an assignment an agency worker has a right to be treated no less favourably that a comparable worker in relation to the collective facilities and amenities provided by the hirer: SI 2010/93 reg 12(1). This is subject to a defence for the hirer of justification on objective grounds: reg 12(2). 'Comparative worker' is defined in reg 12(4) and, while 'collective facilities and amenities' is not exhaustively defined, reg 12(3) states that they include canteen or similar facilities, child care facilities and transport services.
