(8)     Collective or workforce agreements

Regulation 8(5) of the FTE Regs SI 2002/2034 allows an employer and an employee to deviate from the statutory regime by means of a collective or workforce agreement which can provide for a different mechanism to prevent the abuse of fixed-term contracts. In practice, one or more of the following permutations can be adopted:

  1.  

    (a)     a maximum total period during which the employee(s) can be continuously employed on single or successive fixed-term contracts;

  2.  

    (b)     a maximum number of successive fixed-term contracts or renewals under which the employee(s) can be employed;
