(5)     Right to receive a written statement of reasons for less favourable treatment

Fixed term employees are entitled to make a request in writing to their employer for a written statement of reasons if they believe that they are being treated less favourably than a comparable permanent employee (FTE Regs SI 2002/2034 reg 5). The employer must respond to such a request within 21 days. Such statements will be admissible in any proceedings under the Regulations and inferences may be drawn from a refusal to answer or an evasive or equivocal response, including an inference that the employer
