D.     Application of ordinary employment laws

(1)     National Minimum Wage

The national minimum wage does not apply to a child because the basis for entitlement is that the individual (a) is a worker; (b) is working, or ordinarily works, in the UK and (c) has ceased to be of compulsory school age (National Minimum Wage Act 1998 s 1(2) Q [1030]).

A young person who has not attained the age of 18 is excluded from the normal rate of NMW, being entitled instead to a lower rate (National Minimum Wage Regulations 2015 SI
