Where the liability to inheritance tax arising out of a transfer of value by a close company1 falls on a person to whom part of the value transferred has been apportioned2, the following limitations apply:
(1) a person to whom not more than five per cent of the value transferred is apportioned is not, as such, liable for any of the tax
