89. Restraint of trade.

An exclusion of a competitor may amount to an unlawful restraint of trade at common law1 save where it is reasonable2. To be reasonable the basis of the decision3 must be in the interests of the parties4, pursue a legitimate aim worthy of protection5 and do so in reasonable and proportionate manner
