235. Victim intends to start proceedings.

If the Crown Court decides1 that the defendant has benefited from criminal conduct it must decide the recoverable amount2 and make a confiscation order requiring him to pay that amount3. The court is, however, required to treat this duty as a power if it believes that any victim of the conduct has at any time started or intends to start proceedings against the defendant in respect of loss, injury or damage sustained in connection with the conduct
