The Sentencing Council for England and Wales ('the Council') is established by statute1. The principal function of the Council is to prepare, revise and publish sentencing guidelines2 and allocation guidelines3 which the court is required to observe4. The Council must also publish a resource assessment in respect of the draft or definitive guidelines it publishes5.
Resource assessments are required to be published where the Council publishes6 draft guidelines7 or issues guidelines8 as definitive guidelines9. A resource assessment in respect of any guidelines is an assessment by the Council of the likely effect of the guidelines on the resources required for
