Where a court passes a custodial sentence1 in relation to an offence committed after 4 April 20052 it must in general3 be for the shortest term (not exceeding the permitted maximum) that in the opinion of the court is commensurate4 with the seriousness5 of the offence, or the combination of the offence and one or more offences associated6 with it7.
This requirement does not apply in the case of a custodial sentence fixed by law or a life sentence for serious or second listed offences8 and is subject to the statutory provisions specifying:
