If it appears to the Secretary of State1, as regards a fixed-term prisoner2 released on licence3 incorporating a home detention curfew condition4:
(1) that he has failed to comply with the curfew condition included in his licence5; or
(2) that his whereabouts can no longer be electronically monitored at the place for the time being specified in the curfew condition included in his licence6,
the Secretary of State may, if the curfew condition is still in force, revoke the licence and recall the person to prison7. A person whose licence incorporating a home detention curfew condition8 is revoked in this
