559. Sentencing ranges.

When exercising functions relating to the making or revision of sentencing guidelines1 the Sentencing Council for England and Wales2 is to have regard to the desirability of sentencing guidelines3 which relate to a particular offence being structured4 so that the guidelines:


    (1)     if reasonably practicable given the nature of the offence, describe (by reference to one or more of the offender's culpability in committing the offence5, the harm caused, or intended to be caused or which might foreseeably have been caused, by the offence6, and such other factors as the Council considers to be particularly relevant to the seriousness
