197. Seized personal property.

A magistrates' court may by order authorise an appropriate officer1 to realise personal property which is held by a person and which either has been seized by an appropriate officer under a relevant seizure power2 or has been produced3 to an appropriate officer4 if:

  1.  

    (1)     a confiscation order5 is made against the person by whom the property is held6; and

  2.  

    (2)     a receiver has not been appointed7 in relation to the property
