536. Restrictions on imposition of discretionary custodial sentences.

Where a person is convicted of an offence1 which is punishable with a custodial sentence2 the court3 must not pass a custodial sentence unless it is of the opinion that the offence, or the combination of the offence and one or more offences associated4 with it, was so serious5 that neither a fine6 alone nor a community sentence7 can be justified for the offence
