(1) a court varies1 a confiscation order2;
(2) the effect of the variation is to vary the maximum period applicable3 in relation to the order4; and
(3) the result is that that maximum period is less than the term of imprisonment or detention fixed5 in respect of the order6,
the court must fix7 a reduced term of imprisonment or detention in respect of the confiscation order in place of the term previously fixed8.
