597. Protected convictions and cautions.

Certain of the restrictions on, and modifications of, the statutory protections for rehabilitated persons1 are disapplied in connection with protected convictions and cautions2. A person's conviction3 is a 'protected conviction' if:

  1.  

    (1)     the offence of which the person was convicted was not a listed offence4;

  2.  

    (2)     neither a custodial sentence5 or a sentence of service detention6 was imposed in respect of the conviction7; and

  3.  

    (3)     the person has not been convicted of any other offence at any time8,

and 11 years (in the case of an adult offender
