(1) the offence of which the person was convicted was not a listed offence4;
(2) neither a custodial sentence5 or a sentence of service detention6 was imposed in respect of the conviction7; and
(3) the person has not been convicted of any other offence at any time8,
and 11 years (in the case of an adult offender
