A circuit judge or a District Judge (Magistrates' Courts)1 may make an account monitoring order2 on an application by an appropriate officer3 if he is satisfied that:
(1) the order is sought for the purposes of a terrorist investigation4;
(2) the tracing of terrorist property5 is desirable for the purposes of the investigation6; and
(3) the order will enhance the effectiveness of the investigation7.
An application for an account monitoring order may be made without notice to a judge in chambers8. The application must state that the order is sought against the financial institution
