The Secretary of State1 may include a polygraph condition2 in the licence of a person3 who is serving a relevant custodial sentence4 in respect of a relevant sexual offence5 who6:
(1) is released on licence by the Secretary of State under any enactment7; and
(2) is not aged under 18 on the day on which he is released8.
For these purposes, 'relevant custodial sentence' means:
(a) a sentence of imprisonment for a term of 12 months or more (including an extended sentence of detention)9;
(b) a sentence of detention in a young offender institution for a term of 12 months
