For a diminishing number of historical cases, where a prisoner is or was sentenced to a determinate term for an offence that was committed before 4 April 20051, the regimes that govern early release and recall are subject to transitional provisions2. The Legal Aid, Sentencing and Punishment of Offenders Act 2012 brought into effect a simplified transitional regime3 which applies the Criminal Justice Act 2003 provisions that govern early release and recall4 to any person serving a determinate sentence for an offence committed before 4 April 20055, whenever that sentence was or is imposed6, as follows:
