276. Order made: reconsideration of available amount.

If:

  1.  

    (1)     a court has made a confiscation order1;

  2.  

    (2)     the amount required to be paid was less than the defendant's benefit2; and

  3.  

    (3)     the prosecutor3, or an appointed4 receiver5 applies to the Crown Court to make a new calculation of the available amount6,

the court must make the new calculation, and in doing so it must apply the provisions7 relating to the determination of the available amount as if references to the time the confiscation order is made were references to the time of the new calculation and as if references to the date of the confiscation order were
