Where a court has made a confiscation order1, and the defendant2 or the prosecutor or an appointed receiver3 applies4 to the Crown Court to vary5 the order6, the court must calculate the available amount7, and in doing so must apply the provisions8 relating to the determination of the available amount as if references to the time the confiscation order is made were references to the time of the calculation and as if the reference to the date of the confiscation were references to the date of the calculation9.
