Where:
(1) a court has made a confiscation order1;
(2) the designated officer for the magistrates' court applies2 to the Crown Court for the discharge of the order3; and
(3) the amount remaining to be paid under the order is less than £1,0004,
the court must calculate the available amount5, and in doing so it must apply the provisions6 relating to the determination of the available amount as if references to the time the confiscation order is made were references to the time of the calculation and as if references to the date of the confiscation order were references to
