Where the Secretary of State1 refers to the Parole Board2 a case relating to the release or recall of a prisoner3, the chairman4 must appoint:
(1) a single member of the Board to constitute a panel5 to deal with a case where the Board is to consider the initial release of a prisoner serving an indeterminate sentence6; and
(2) one or more members of the Board to constitute a panel7, in any other case8.
A person appointed under head (1) above may not in the same case sit on a panel appointed under head (2) above9.
