If a fixed-term prisoner1:
(1) is serving a sentence which is for a term of 1 day2;
(2) is serving a sentence which is for a term of less than 12 months3 and is aged under 18 on the last day of the requisite custodial period4; or
(3) is serving a sentence which is for a term of less than 12 months5 and the sentence was imposed in respect of an offence committed before 1 February 20156,
it is the duty of the Secretary of State7 to release him unconditionally as soon as he has served the requisite custodial period8.
