In relation to a prisoner who is serving an extended determinate sentences ('EDS') imposed for certain violent or sexual offences1, it is the duty of the Secretary of State2 to release him on licence3 as soon as he has served the requisite custodial period4 specified for these purposes if:
(1) the sentence was imposed before 13 April 20155;
(2) the appropriate custodial term is less than ten years6; and
(3) the sentence was not imposed in respect of a listed offence7.
In any other case it is the duty of the Secretary of State to release the prisoner on licence
