Where a conviction1 or caution2 has become disregarded3 the Secretary of State must by notice4 direct the relevant data controller5 to delete6 details, contained in relevant official records, of that conviction or caution7. Such notice may be given at any time after the Secretary of State has decided that the conduct constituting the offence was consensual and would now be lawful
