The court may make a hospital or guardianship order1 if:
(1) the court is satisfied, on the written or oral evidence of two registered medical practitioners2, that the offender or person in respect of whom the order is proposed to be made3 is suffering from mental disorder4 and that either:
(a) the mental disorder from which the person is suffering is of a nature or degree which makes it appropriate for him to be detained in a hospital for medical treatment and appropriate medical treatment is available for him5; or
(b) in the case of a person who has
