544. Cases which may be referred.

The cases which may be referred to the Court of Appeal for review1 are:

  1.  

    (1)     any case in which sentence2 is passed on a person for an offence triable only on indictment3;

  2.  

    (2)     any case in which sentence is passed on a person for any of the following statutory sexual offences which are triable either way (and thus not included under head (1) above)4:

    1.  

      (a)     sexual assault5;

    2.  

      (b)     causing a person to engage in sexual activity without consent6;

    3.  

      (c)     sexual assault of a child aged under 137;

    4.  

      (d)     causing or inciting a child under 13 to engage in sexual activity8;

    5.  

      (e)     sexual activity with a child9;

    6.  

      (f)     causing or inciting a child to engage in sexual activity10;

    7.  

      (g)     engaging in sexual activity in the presence of a child11;

    8.  

      (h)     causing a child to watch a sexual act12;

    9.  

      (i)     arranging or facilitating the commis
