The amount payable under an unlawful profit order made in criminal proceedings1 must be such amount as the court considers appropriate, having regard to any evidence and to any representations that are made by or on behalf of the offender or the prosecutor2. However if (and only if) a magistrates' court has convicted a person aged under 183 of an offence or offences, then:
(1) the amount to be paid under an unlawful profit order made by the court in respect of the offence or any one of the offences may not exceed £5,0004; and
