An applicant for a writ of habeas corpus for release must make the application by filing a claim form1 and a witness statement or affidavit2 stating that the application is made at his instance and setting out the nature of the detention3. The application must be made by the detained person4 unless he is unable to make it, in which case it may be made by some other person on his behalf and must state that the detained person is unable to make it5. The application may be made without notice
