228. Treatment insufficiently serious to be categorised as torture.

Inhuman and degrading treatment that is not considered sufficiently serious to be categorised as torture will nevertheless engage the Article 3 prohibition1 if it attains a minimum level of severity2. The assessment of this minimum depends on all the circumstances of the case, including: the duration of the treatment, its physical or mental effects, and the sex, age and state of health of the victim3; and the purpose for which the treatment was inflicted, the intention or motivation behind it, and its context, such as in an atmosphere of heightened tension and emotions
