294. Right to compensation.

Everyone who has been the victim of arrest or detention in contravention of the provisions of Article 51 has an enforceable right to compensation2 which domestic legal systems must afford with a sufficient degree of certainty3 and without prejudice to the courts' competence to award4 just satisfaction5. It is permissible to predicate any award of compensation on proof of pecuniary or non-pecuniary damage resulting from the breach6, although such non-pecuniary damage does not always sound in monetary compensation
