If it is impossible for the person to whom the writ of habeas corpus for release is directed to produce the body of the person alleged to be in his custody by reason of his having parted with the custody of that person before the service of the writ, he must nevertheless make a return setting out the facts unequivocally and distinctly and showing the reason why he is unable to obey the writ
