408. Restrictions relating to respect for the home.

The loss of a person's home is the most extreme form of interference with the right to respect for the home under Article 81, and any person at risk of such an interference must in principle be able to have the proportionality of the measure determined by an independent tribunal in light of the relevant Article 8 principles, notwithstanding that, under domestic law, his right to occupation has come to an end2. Nonetheless, where a residential occupier of local authority accommodation has no contractual or statutory protection, and the authority is entitled to possession as a matter of domestic
