330. Proceedings must be determinative.

A person facing a criminal charge1 will be able to rely on the Article 6 safeguards until the charge is determined2. This period may include pre-trial proceedings3 and extends until appeal proceedings have ended4, but not a failed request to reopen a case5: thus only those proceedings which form part of or constitute the determination of the applicant's guilt or innocence will engage the criminal limb of Article 6
